ROYALTY DEED
Calvin L. Huggins & wife Mary to Cyrus P. Huggins

THIS DEED, Made this 20th day of July, A.D. 1907, by and between Calvin L. Huggins {sic} and Mary E. Huggins, his wife, of Marshall County, West Virginia, parties of the first part; and Cyrus P. Huggins, of Wetzel County, West Virginia, party of the second part.
WITNESSETH, That in consideration of the sum of Sixty Dollars ($60.00), cash in hand paid by said second party to said first parties, the receipt whereof is hereby acknowledged, the said parties of the first part do grant, with covenants of general warranty, unto the said parties of the first part in and to all of the oil and gas and oil and gas rights and privileges within and underlying and connected with all of three certain tracts or parcels of land, all adjoining, and situate on the waters of Proctor Run, in Proctor District, Wetzel County, West Virginia, the first tract thereof containing eighty (80) acres, more or less, and conveyed to John R. Huggins by John Bennet and wife, by deed, dated, Aug. 29, 1843 and of record in deed book, 9, Folio, 359 in Tyler County, West Virginia;
and the second tract of land containing five and 15/16 (5 15/16) acres, more or less, and conveyed to John R. Huggins by Ira C. Yoho and wife, by deed, dated, Feb. 8, 1889, and of record in Deed Book, 25, Page, 265, in Wetzel County;
and the third tract of land containing one and ¼ (1 ¼) acres, more or less, and conveyed to John R. Huggins by Margaret Butler by deed, dated, the 30th day of Aug. 1892, and of record in deed book, 40, Page 179, in Wetzel County – which lands after the death of the said John R. Huggins were partitioned in suit in Chancery in Circuit Court of said County, between the heirs of the said decedent and their assigns;
and the said Calvin L. Huggins being one of three grandchildren of said John E. Huggins by his daughter, Armina Henry, deceased, he, the said Calvin Huggins inherited an undivided one twenty first (1/21) of the estate of the said John R. Huggins;
and the said Calvin L. Huggins and wife heretofore and by deed, dated, March 19, 1904, and recorded in Deed Book, 90 Page, 232, conveyed to the said Cyrus P. Huggins the said undivided 1/21st share in said land, except the royalties of oil and gas within and underlying the same;
and the object of this present deed is to and the same does convey and grant to the said Cyrus P. Huggins all of the interest, right, title and estate of said first parties in the oil and gas royalties, and all the oil and gas whatsoever, and oil and gas rights and privileges within and underlying or in any way connected with said lands.

I, A. L. Franklin a Notary Public in and for the said county of Marshall, State of West Virginia, do certify that Calvin L. Huggins and Mary E. Huggins, his wife, whose names are signed to the foregoing writing, bearing date on the 20th day of July, 1907, have this day acknowledged the same before me in my said County of Marshall.
