    Received from the Circuit Court Clerk, Wetzel County West Virginia

 

    State of West Virginia vs Harrison Huggins, George W. Huggins, William T. Huggins and Henry Nelson Huggins - FELONY

 

    

    This day came again the said state by the Prosecuting Attorney and the prisoner George W. Huggins was again led to the Bar of the Court in his own proper person in the custody of the sheriff of Wetzel County, and the motion made by the prisoner George W. Huggins on a former day of this term to set aside the verdict of the Jury returned on a former day of the term and grant him a new trial because the same is contrary to the law and the evidence was maturely considered by this Court whereupon the Court doth overrule said motion and doth refuse to set aside said verdict to which ruling of the Court the prisoner excepted and the Court proceeding now to pronounce sentence and Judgment against the prisoner George W. Huggins, the Court doth ascertain and fix the term of his imprisonment in the Penitentiary of this state for the term of five years.

 

    It is therefore considered by the Court that the said prisoner George W. Huggins be imprisoned in the Penitentiary of this state for the term of five years and that the sheriff of this county do as soon as possible after the adjournment of this Court remove and safely convey the said prisoner George W. Huggins from this County Jail to the Penitentiary of this state of Moundsville and there to be kept imprisoned and heald {sic} in the manner prescribed by law and thereupon on the suggestion and motion of the prisoner the execution of said Judgment is suspended for sixty days the time asked for by the prisoner for the purpose of allowing him opportunity to present his petition to the Supreme Court for Writ of Error if he so desire.


 

 

    This day came the state by her attorney and thereupon the prisoner Harrison Huggins who stands convicted of Murder in the second degree was lead {sic} to the bar of the Court in custody of the sheriff of this county and the motion made by the prisoner on the 28th day of January 1895 to set aside the verdict of the Jury in this cause and grant him a new trial therein because the same {is} contrary to the law and evidence being duly considered by the Court, the Court doth overrule said motion and doth refuse to grant the prisoner Harrison Huggins a new trial therein, and the Court proceeding now to pronounce sentence and Judgment against the prisoner Harrison Huggins, the Court doth ascertain and fix the term of his imprisonment in the Penitentiary of this state for the term of five years.

    It is therefore considered by the Court that the said prisoner Harrison Huggins be imprisoned in the Penitentiary of this state for the term of five years and that the sheriff of this county do as soon as possible after the adjournment of this Court removed and safely convey the said prisoner Harrison Huggins from the County Jail to the Penitentiary of this state at Moundsville and there to be kept imprisoned and treated in the manner prescribed by law and thereupon on motion of the prisoner Harrison Huggins the execution of said Judgment is suspended for thirty days and thereupon the prisoner was remanded to jail.


 

 

    This day came the state by her attorney and thereupon the prisoner William T. Huggins who stands convicted of Voluntary Manslaughter was again led to the bar of the Court in custody of the sheriff and the motion made by the prisoner on the 30th day of May 1895 to set aside the verdict of the Jury rendered in this cause and grant him a new trial therein being duly considered by the Court, the Court doth overrule said motion and doth refuse to grant the prisoner William T. Huggins a new trial therein and the Court proceeding now to pronounce sentence and Judgment against the prisoner William T. Huggins, the Court doth ascertain and fix the term of his imprisonment in the Penitentiary of this state for the term of one year.

It is therefore considered by the Court that the said prisoner William T. Huggins be imprisoned in the Penitentiary of this state for the term of one year and that the sheriff of this county do as soon as possible after the adjournment of this Court removed and safely convey the said prisoner William T. Huggins from the County Jail to the Penitentiary of this state at Moundsville and there to be kept imprisoned and treated in the manner prescribed by law and thereupon on motion of the prisoner William T. Huggins the execution of said Judgment is suspended for thirty days and thereupon the prisoner was remanded to jail.


 

 

    This day came the state by her attorney and thereupon the prisoner Henry Nelson Huggins who stands convicted of Murder in the second degree was lead {sic} to the bar of the Court in custody of the sheriff of this county and the motion maid {sic} by the prisoner on the 3rd day of June 1895 to set aside the verdict of the Jury in this cause and grant him a new trial therein because the same is contrary to the law and evidence being duly considered by the Court, the Court doth overrule said motion and doth refuse to grant the prisoner Henry Nelson Huggins a new trial therein and the Court proceeding now to pronounce sentence and Judgment against the prisoner Henry Nelson Huggins, the Court doth ascertain and fix the term of his imprisonment in the Penitentiary of this state for the term of five years.

     It is therefore considered by the Court that the said prisoner Henry Nelson Huggins be imprisoned in the Penitentiary of this state for the term of five years and that the sheriff of this county do as soon as possible after the adjournment of this Court removed and safely convey the said prisoner Henry Nelson Huggins from the County Jail to the Penitentiary of this state at Moundsville and there to be kept imprisoned and treated in the manner prescribed by law and thereupon on motion of the prisoner Henry Nelson Huggins the execution of said Judgment is suspended for thirty days and thereupon the prisoner was remanded to jail.

 

 

Ordered that the Court do now adjourn until the first day of the next term.
